Man arrested on sixth drunken driving offense

A Town of Burlington man is facing felony charges after picking up his sixth drunken driving offense over the weekend.

James Allen Werner, 44, was charged Monday in Racine County Court with operating while intoxicated, fifth or sixth offense.

If convicted, Werner could face fines of more than $10,000 and six years in prison.

Werner had three OWI convictions from September of 1994 through March of 1996, and two more convictions in 2008.

According to the criminal complaint, a Racine County Sheriff’s Deputy was dispatched to Spring Valley Road at around 4 p.m. Friday.

The deputy was advised that a vehicle hit a pole and that wires had come down. When he arrived, he reported he saw a vehicle parked in the driveway at Werner’s residence. He also saw a boat lying on the ground between the road and bushes on the west side of the property.

Werner reportedly admitted to driving the car, and that he had tried to use the vehicle to pull the boat in the front yard. Werner reportedly told the deputy that the boat got caught on a border on the north side of the property before giving way, and Werner said he was unable to brake and struck the utility pole.

The deputy reportedly detected an odor of intoxicants on Werner, as well as observing bloodshot eyes and the fact Werner was stumbling.

Werner reportedly failed field sobriety tests, and when tested, had an alcohol level of .15 on the portable breath test.
