A 20-year-old Wind Lake man faces up to 40 years in prison after being charged with second degree sexual assault of a child.

Zachariah P. Bakke allegedly raped a then 14-year-old girl in the basement of his Wind Lake home in September of 2011.

According to the criminal complaint, Bakke and the victim were at the house for a birthday party. The victim told police she and Bakke were watching a movie in the basement when Bakke asked her to have sex with him.

The victim told police she said no and that they continued to watch the movie. The victim told police Bakke then “bothered her to have sex” and she told him, “No. Everyone’s upstairs. I don’t want to have sex.”

The victim said Bakke kept harassing her and began begging saying, “Please, come on.”

She told police she and Bakke were kissing and that she told him “two or three” more times she didn’t want to have sex.

According to the complaint, Bakke then physically forced the girl to have intercourse. When police interviewed Bakke about the incident, he admitted to knowing the girl was too young to give consent to have sex. Bakke told police that after the act, “he felt sorry because he didn’t feel right.”

When police asked him why he didn’t feel right, Bakke told police that she did not want to have sex but he “just lost it.” Bakke told police he felt “bad” because she told him no.

If convicted, Bakke could be fined up to $100,000 and/or imprisoned for up to 40 years.

Bakke is scheduled to appear in Racine County Court Sept. 20.
