Sleep walking defense in sexual assault of girl

A Waterford man has been charged with first-degree sexual assault of a child after taking nude photos of a 10-year-old girl and then assaulting her.

According to the criminal complaint filed Oct. 10 in Racine County Court:

The victim was at the home of Christopher M. Forker, 38, the night of Oct. 6. The victim told police she was awakened at about 2 a.m. Oct. 7 by camera flashes. The victim said she noticed that she had been partially undressed and Forker was taking inappropriate pictures of her.

The girl told police she was “very scared and confused and that she closed her eyes and waited for it to be over.”

After taking the photos, the victim told police that Forker sexually assaulted her.

When questioned, Forker told police that the girl “does not lie and if she said I did, I must have, but I don’t remember.”

Forker said that he sometimes drinks and doesn’t remember what he does. He also told police he was a sleepwalker and doesn’t remember what he does when that happens either.
