Lawyer weighs in on Sanitary District employee issues

The new leadership of the Town of Waterford Sanitary District may find itself in hot water, legally speaking.

According to an attorney hired by the district’s three full-time employees, recent postings for closed meetings held to discuss possible disciplinary action are clear violations of the state Open Meetings Law.

The employee issues being examined have not been made public. WSD Board President Dan Dickinson has alluded to them as unspecified “observations” that commissioners have made. Employee “cooperation” issues have been noted on a recent agenda.

In a Nov. 2 letter to Dickinson, Delafield attorney Paul Bucher demands that the WSD board honor his clients’ request that “any and all hearings relative to disciplinary action” be held in open session.

Bucher, a former district attorney for Waukesha County, represents the WSD administrator, Debbie Nelson; operations superintendent, Norm Nelson; and operations assistant, Jerry Ignatowski.

Bucher also demands a “listing of all charges and information concerning any aspect of this matter that could result in disciplinary action” against his clients.

“My clients are entitled to due process and that is impossible when no information has been provided concerning the particular charges,” Bucher wrote.
