An early-morning disagreement between family members turned into the report of a pedestrian hit by a car in the Town of Burlington Christmas Day.

The Racine County Sheriff’s Department reported that it had responded to a call for a vehicle-vs.-pedestrian incident on Ketterhagen and Crossway roads in the Town of Burlington.

The victim – who was found in front of a vehicle – was taken first by ambulance to Aurora Memorial Hospital of Burlington, and then by Flight for Life to Froedtert Hospital after apparently being struck by a vehicle driven by his father.

However, as the investigation moved forward Tuesday and Wednesday, the Racine County District Attorney’s office declined to seek charges against the driver of the vehicle.

According to officials, Daniel Churchija, 60, was driving the vehicle at about 3:50 a.m. when he and his son, Michael, apparently got into a fight in the vehicle. That fight then moved outside of the vehicle. Exactly how Michael Churchija was injured remains under investigation, however.

There is no suspicion of alcohol use against Daniel Churchija, but Sheriff’s Department Public Information Officer Steve Sikora said Wednesday that there was alcohol use suspected on the son’s part.

Michael Churchija remained at Froedtert in stable condition with non-life-threatening injuries Wednesday.

The investigation is ongoing.
