Officer’s drunken driving case postponed

Judgment in a drunken driving case involving a City of Burlington police officer has been postponed until September.

The initial court appearance of Eric Mitchell, a City of Burlington police officer who allegedly drove off a road and hit a tree last December in Walworth County, has been postponed four times now, this time until Sept. 21 at 3 p.m.

Due to the rotation of judges, the case was also transferred to the court of Judge Phillip Koss.

A representative from the Walworth County Clerk of Courts office said Tuesday that traffic counts are “always adjourned” from initial appearances until the case is resolved.

Mitchell is accused of driving home drunk from a fellow officer’s home following an evening of renovation work at the other officer’s home.

Mitchell allegedly had a blood-alcohol level of .16, resulting in an additional charge of having a prohibited alcohol content of above .15.

In that offense, if guilty, Mitchell would be forced to have an interlock device placed in any vehicle he drives to screen for alcohol levels. As a City of Burlington police officer, that machinery cannot be installed in a squad vehicle, and there are no desk jobs available at the police station.
