Many runs afoul with police on consecutive days

A Delavan man may not be welcome back at the Burlington Walmart after last weekend.

Salvatore Michele Marino III, 19, was arrested twice in two days – first for drunken driving at Walmart Saturday and then for synthetic marijuana possession on Sunday.

He was charged in Racine County Circuit court Monday for two misdemeanor chargers related to the second arrest.

According to the criminal complaint, a manager at Walmart called police Saturday to report a man asleep in a vehicle. When she allegedly knocked on his window, he fled the parking lot at a high rate of speed.

Police eventually stopped Marino and cited him for his second drunken driving offense.

On Sunday, the same City of Burlington officer saw him in the parking lot at Walmart, and pulled alongside him, allegedly asking when he’d gotten out of jail.

Marino apparently replied with “this morning,” and then told the officer he had come back to Walmart to sit there with it running to “keep the heat on.”

Marino allegedly took something off his lap and tried to put it in the center console of the vehicle, and then tried to roll up the driver’s side window. According to the City of Burlington police report, the officer observed Marino’s speech slow, eyes bloodshot and droopy eyelids.

When the officer got out of the vehicle to look in Marino’s car, he allegedly saw the same type of pipe Marino had been using the day before. The officer asked Marino to get out of the car. When the officer asked what Marino was smoking, Marino allegedly replied K2 (synthetic marijuana).

The officer allegedly asked if Marino had learned anything from the day before, to which Marino allegedly replied he was only smoking in the parking lot, not driving.

Marino then pleaded with the officer to let him go. A search of the vehicle allegedly found more homemade pipes and more alleged drugs, which were tested and found to be K2.

A criminal history check found that Marino had been arrested June 27 in Fontana for driving while impaired.
